We humbly request that you not post, the aforementioned bills as they are still quite flawed and do not fairly represent the OHV users of the state. We have worked endlessly with members of the legislature, the DEP ,MVC and members of various environmental groups trying to come to a fair solution to the users not having safe and legal facilities for this family activity which in turn would drastically diminish the effects of the illegal riding taking place. These bills although they appear to fill the requirement of providing legal access for users fall short in that the DEP simply needs to write to the legislature and the Governor and explain that they cannot find a suitable location. This same verbiage has been in Title 39 since 1985 in c.39:3c-14 to provide an ATV safety training facilities, which they also have been collecting a $ 5.00 fee per registration and have provided us with nothing. Are we to believe anything will change ??We are not opposed to enforcement and paying our own way,but we need legal venues.
We also question why there would be an additional $10 fee for the "Off-Road Vehicle Recreation Fund" and given to the D.E.P., when the D.E.P. has repeatedly said they will not be running any aspects of these parks. This fund should be for those non-profit organizations that will be running the parks.
We ask that these bills do not get posted for floor votes list until these and other inequities are addressed.We continue to work toward a common ground solution,but these bills do not do our community justice,as it is just another tax on a small user group.
