A bipartisan amendment has been introduced that would restore judicial review – habeas corpus—so detainees held as enemy combatants could challenge their treatment and detention in When Congress passed the Military Commissions Act in September 2006, it stripped habeas corpus protections for anyone designated by the President as an “enemy combatant.” The Center for Victims of Torture views habeas corpus as a necessary tool to examine allegations of abuse so mistreatment does not continue unchecked. It is also an important check to protect individuals from arbitrary detention.
Senators Arlen Specter (R-PA) and Patrick Leahy (D-VT) have introduced an amendment to the Department of Defense Authorization Act (S. 2022) to restore habeas corpus.
