The short explanation of this alert was:

In an upsetting and alarming decision earlier today, the State Board of Health voted to increase medical record fees in spite of overwhelming opposition from consumers and health advocacy organizations including the Colorado Cross Disabilities Coalition, Colorado AIDS Project and Family Voices.

This vote means that people or organizations other than the patient or the patient's representative will now be charged an even higher rate for copies of medical records. This exacerbates individuals' ability to apply for public programs including social security and disability services.  When advocacy organizations or Lawyers seek medical records on behalf of of their clients these high prices are often passed on to the patient.

In addition, the Board of Health ignored  arguments that the current fee structure violates HIPAA because it includes expenses outside of copying. The Board's decision to increase these fees further aggravates this problem.

CCHI is working with our legal team to appeal this ruling.
